1. Acceptance of Terms

By accessing and using the Mailsniper API service ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms, you must not access or use the Service.

2. Description of Service

Mailsniper provides an API service for email domain validation and disposable email detection. The Service allows you to verify email addresses, detect disposable email domains, and analyze email address quality through our API endpoints.

3. API Usage and Limits

• Upon registration, you receive a limited number of free API requests as displayed in your account dashboard
• Usage is subject to rate limiting to ensure fair access for all users
• You may not exceed the allocated request limits without upgrading your plan
• API keys are confidential and must not be shared or exposed publicly

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Attempt to interfere with, compromise, or disrupt the Service
• Use the Service to send spam or unsolicited communications
• Reverse engineer, decompile, or attempt to extract source code
• Resell or redistribute the Service without written permission

5. Data Privacy and Security

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. Key points:

• API requests, including submitted email addresses and response data, are logged for support, abuse prevention, and quota tracking as described in our Privacy Policy
• Your account information is protected using industry-standard security measures
• We use encryption in transit, hashed password storage, and role-based access controls

6. Data Processing Responsibilities

When you submit email addresses or domains to the Service for validation, you represent and warrant that:

• You have a lawful basis (such as legitimate interest or consent) for processing those email addresses
• You have obtained all necessary rights and consents to submit such data to a third-party service
• Your use of the validation results complies with all applicable data protection laws, including the GDPR where applicable
• You will not submit data that you know to be unlawfully obtained

You remain the data controller of any personal data you submit to the Service. We process it on your behalf as described in our Privacy Policy.

7. Service Availability and Warranty Disclaimer

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free
• The results obtained from the Service will be accurate or reliable
• Any defects in the Service will be corrected

We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice. Scheduled maintenance windows will be communicated in advance where practicable.

8. API Versioning and Deprecation

We may release new versions of the API or deprecate existing versions over time. When deprecating an API version, we will provide reasonable advance notice through our documentation or via email. You are responsible for monitoring our documentation and changelogs for updates that may affect your integration.

9. Intellectual Property

The Service, including all content, features, and functionality, is owned by Mailsniper and is protected by copyright, trademark, and other intellectual property laws.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Mailsniper shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of profits, data, business opportunities, or goodwill. Our total aggregate liability for all claims arising from or related to the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Mailsniper and its affiliates, officers, and employees from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any third-party rights, including data protection or privacy rights, or (d) any data you submit to the Service.

12. Account Termination

We reserve the right to terminate or suspend your account at any time for violation of these Terms or for any other reason at our sole discretion. You may also close your account at any time by contacting us.

Upon termination, your right to use the Service ceases immediately. We will handle your data in accordance with our Privacy Policy, including the retention and deletion practices described therein.

13. Force Majeure

Neither party shall be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from events beyond the reasonable control of that party, including but not limited to natural disasters, acts of government, internet or telecommunications failures, cyberattacks, pandemics, or other force majeure events.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Users will be notified of significant changes via email or through the Service. Your continued use of the Service after such notification constitutes acceptance of the updated Terms.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Germany.
